Look at Wowscape, they haven't been sued. I say go for it.

It's pretty hard to get sued for anything over the internet, (Excluding really REALLY illegal things, like child pornography) especially so if you live in a country without specific laws. I haven't heard of any big suits against private WoW servers, so it seems pretty safe. Most of them seem to put something in their Terms of Use about nobody from Blizzard being able to view their site, which gives you some legal defence, I suppose.

Offshore hosting my friend!

Your in the clear if your server isn't hosted in the US. Even IF it is hosted in the US, it's about the same as getting sued for downloading music. EVERYONE does it. They simply can't keep up.

By the way. A legal disclaimer like "Blizzard or blizzards reps may NOT enter" is a fluke. It would NOT hold up in a court room. They can very simply get around that if infact the judge didn't laugh in your face first.
